So this isn't talking about, you know, 0:02:08.360 --> 0:02:11.480 bringing a gun into somebody's house without their authorization. Is 0:02:11.560 --> 0:02:16.480 talking about going into a store and walking into a 0:02:16.520 --> 0:02:19.400 grocery store, or being able to go into another place 0:02:19.400 --> 0:02:22.720 that is generally open to the public. I can't 0:06:23.680 --> 0:06:28.680 pronounce these names. Are Mullen versus Doe. Alito writing the 0:06:28.760 --> 0:06:32.159 opinion on both those six y three decisions break this 0:06:32.279 --> 0:06:35.840 down for US because asylum seekers they wanted to have 0:06:35.920 --> 0:06:38.600 some rights, and the justices pretty much said. 0:06:38.400 --> 0:06:41.720 No, Yeah, Look, there's a couple of different cases. And 0:06:41.760 --> 0:06:44.520 both of these are really, really really important cases, not 0:06:44.560 --> 0:06:48.000 only for the propositions that they stand for, but because 0:06:48.000 --> 0:06:51.240 also they are nearly a decade in the making, both 0:06:51.279 --> 0:06:54.719 of them. So All Ultra Lato was a case that 0:06:54.800 --> 0:06:56.800 applied to a practice of the Department of Home in 0:06:56.880 --> 0:07:01.160 Security that was known as metering. And this is fundamentally 0:07:01.600 --> 0:07:03.880 common sense to the American people. So folks at home 0:07:04.040 --> 0:07:09.440 understand that if you're managing the border and someone is 0:07:09.520 --> 0:07:13.200 in Mexico, they have not yet entered into the United States. 0:07:13.240 --> 0:07:16.040 The notion that you can't do anything that you have 0:07:16.160 --> 0:07:18.480 to allow them to come into the United States. You 0:07:18.560 --> 0:07:21.760 have to allow yourself to be overwhelmed with people who 0:07:21.760 --> 0:07:24.840 claim that they have the right to seek asylum, who 0:07:24.960 --> 0:07:27.720 but again, who have not yet entered the United States. 0:07:27.720 --> 0:07:30.080 The Supreme Court has affirmed, based on the way that 0:07:30.120 --> 0:07:34.119 Congress wrote the statute, that in fact, the United States 0:07:34.120 --> 0:07:38.559 government does have the sovereign right, the sovereign right based 0:07:38.600 --> 0:07:42.240 on the statute as well to say no, you don't 0:07:42.240 --> 0:07:44.560 get there. Just because you're an asylum seeker doesn't mean 0:07:44.560 --> 0:07:46.760 that you get to demand entry, doesn't mean that you 0:07:46.840 --> 0:07:51.040 get to demand asylum from Mexico. So it was a 0:07:51.120 --> 0:07:55.560 tremendous vindication of a practice that is common sense. It's 0:07:56.160 --> 0:07:58.640 one of the most common sense things you could ever imagine. 0:07:58.680 --> 0:08:01.480 It's like going to the deli counter at the grocery store. 0:08:01.640 --> 0:08:03.800 You don't get to just walk behind the counter and 0:08:04.160 --> 0:08:06.720 cite your own needs. Look, when I first got elected to 0:08:23.240 --> 0:08:25.960 Congress back in two thousand and eight, so the beginning 0:08:25.960 --> 0:08:28.400 of two thousand and nine, I'm on the Judiciary Committee. 0:08:28.720 --> 0:08:31.680 I'm not an attorney. I know that sounds like I'm bragging, 0:08:31.760 --> 0:08:34.040 but I'm not an attorney. But I was on Judiciary, 0:08:34.320 --> 0:08:36.760 and I was on the Immigration subcommittee, and it was 0:08:36.920 --> 0:08:39.480 very clear even back then that one of Obama's because 0:08:39.480 --> 0:08:42.480 I elected at the same time as Barack Obama, they 0:08:42.520 --> 0:08:44.840 were going to try all kinds of things because they 0:08:44.880 --> 0:08:47.880 knew it would take a long time, years if not decades, 0:08:48.200 --> 0:08:49.920 to sort it out in the courts. And one of 0:08:49.920 --> 0:08:52.920 the things they did is they changed the definition of 0:08:52.960 --> 0:08:56.760 credible fear. And then they started doing everything they could 0:08:56.800 --> 0:09:01.760 to use asylum. And people would show up at the 0:09:01.760 --> 0:09:04.400 border with pre written scripts. They'd pull them out of 0:09:04.440 --> 0:09:07.880 their pockets and then just read it instead of answering 0:09:07.880 --> 0:09:10.360 the questions. And so we could go deep into this. 0:09:10.440 --> 0:09:16.360 But nevertheless, the Ninth Circuit yet again has a decision 0:09:16.520 --> 0:09:19.600 that has been overturned by the Supreme Court in a 0:09:19.640 --> 0:09:20.679 sixty three ruling. 0:09:21.480 --> 0:09:22.080 Absolutely. 0:09:23.240 --> 0:09:25.400 All right, let's go to the next one. Let's go 0:09:25.440 --> 0:09:32.559 to Mullen versus dough. This is about temporary somehow Democrats 0:09:32.600 --> 0:09:38.199 lose the definition of that temporary protected status TPS as 0:09:38.240 --> 0:09:41.200 they call it. Explain what this ruling does. 0:09:42.160 --> 0:09:45.520 Yeah, so, look, the takeaway point for the folks at 0:09:45.520 --> 0:09:49.920 home is that when Congress says that something is up 0:09:49.960 --> 0:09:53.679 to the secretary's discretion, the Secretary of Homeland Security, when 0:09:53.760 --> 0:09:57.000 Congress writes that in a statute and says no court 0:09:57.200 --> 0:10:01.679 can review the secretary's discretion. The Supreme Court's decision today 0:10:01.800 --> 0:10:06.200 means that that word that phrase actually means something. So 0:10:06.280 --> 0:10:09.679 let's unpack it a little bit. TPS Temporary Protected status is, 0:10:09.760 --> 0:10:14.199 of course, it is a status that DHS can grant 0:10:14.360 --> 0:10:18.520 to nationals of a particular country who are already in 0:10:18.559 --> 0:10:20.920 the United States in the events that there are some 0:10:21.040 --> 0:10:23.360 kind of emergency, there's some kind of a hurricane, there's 0:10:23.360 --> 0:10:27.480 an earth, there's a war, something that creates it makes 0:10:27.480 --> 0:10:32.280 it renders it unsafe for people to return to the 0:10:32.280 --> 0:10:35.959 country because of those conditions. But some of these designations 0:10:35.960 --> 0:10:38.800 have been made decades ago based on hurricanes that happened 0:10:38.800 --> 0:10:41.840 in like nineteen ninety eight. And so when the Department 0:10:41.840 --> 0:10:47.960 of Homeland Security previously has tried to terminate temporary protected status, 0:10:48.160 --> 0:10:52.120 there have been plaintiffs who have brought lawsuits alleging all 0:10:52.240 --> 0:10:54.679 kinds of things, saying that all this was in the 0:10:54.760 --> 0:10:57.720 right decision. We think that this was motivated by this, 0:10:57.800 --> 0:11:01.959 that or the other. We disagree with the decision, YadA, YadA, YadA, 0:11:01.960 --> 0:11:05.079 and courts have tied up the ability of the administration 0:11:05.360 --> 0:11:10.880 to end these temporary programs when Congress very clearly, very 0:11:10.880 --> 0:11:13.680 clearly in the statute said this is something that is 0:11:14.000 --> 0:11:17.480 left to the Secretary's discretion. And so if the Secretary 0:11:17.559 --> 0:11:21.480 says that we are ending TPS, courts can't interfere, they 0:11:21.520 --> 0:11:24.600 can't get involved. This is a massive win for the 0:11:24.679 --> 0:11:26.920 rule of law and for people who want to do 0:11:27.040 --> 0:11:27.720 the right thing. 0:11:29.520 --> 0:11:33.320 We're talking, of course with Gene Hamilton, the President of 0:11:33.360 --> 0:11:36.800 America first legal and Gene. That brings us to the 0:11:36.800 --> 0:11:39.840 big one, the big kahuna, if you will, the big 0:11:40.040 --> 0:11:45.000 daddy of them all wasn't there today. But the biggest one, 0:11:45.080 --> 0:11:50.160 I believe is birthright citizenship. This is going to be 0:11:50.200 --> 0:11:54.600 a big, big ruling. They haven't released it yet. What's 0:11:54.600 --> 0:11:58.160 your prediction based on these two rulings that we see 0:11:58.200 --> 0:12:00.480 on immigration, Where do you think the Court's going with 0:12:00.559 --> 0:12:01.679 birthright citizenship? 0:12:02.240 --> 0:12:04.480 Yeah, well, I mean there's where I wish they would 0:12:04.480 --> 0:12:08.040 go and where they end up. Of course, I am 0:12:08.120 --> 0:12:11.360 very hopeful for the right result, a result that's rooted 0:12:11.400 --> 0:12:16.040 in a proper understanding of the Fourteenth Amendment and the 0:12:16.120 --> 0:12:19.599 clause set off by Commas in subject to the jurisdiction 0:12:19.679 --> 0:12:23.920 thereof and all of the common sense reasons why birthright 0:12:23.960 --> 0:12:28.280 citizenship makes no sense and has no constitutional underpinnings that 0:12:28.840 --> 0:12:31.160 underwrite it. What I you know, I mean, if you're 0:12:31.200 --> 0:12:32.839 going to put a gun to my head and ask 0:12:32.920 --> 0:12:35.480 me to make a prediction today, as hopeful as I 0:12:35.520 --> 0:12:39.840 am for the right decision, my prediction is that the 0:12:39.880 --> 0:12:44.840 Court will find a way to resolve the case that 0:12:44.920 --> 0:12:47.680 doesn't end up with a pure majority, but that ends 0:12:47.760 --> 0:12:53.000 up not upholding the president's executive order in this case 0:12:53.000 --> 0:12:56.000 at leaves for another day the decision on the constitutional 0:12:56.080 --> 0:13:00.640 question as to whether or not there's a right to 0:13:00.800 --> 0:13:03.600 citizenship for folks who were born here to the parents 0:13:03.600 --> 0:13:07.000 who are illegal. But you know, 0:13:28.440 --> 0:13:30.400 I don't know. It's one of these things. When you 0:13:30.480 --> 0:13:32.439 get a couple of good wins in the immigration space, 0:13:32.440 --> 0:13:35.520 when it comes to the Supreme Court, that means sometimes 0:13:35.559 --> 0:13:36.960 you're going to get a you're going to get a 0:13:37.000 --> 0:13:38.200 loss kind of down the line. 0:13:38.320 --> 0:13:41.400 So that would be the biggest one.
