And you know, 0:03:58.600 --> 0:04:02.000 there are lots of folks who will tell you that, well, 0:04:02.040 --> 0:04:04.680 I don't know a trans person, or this doesn't affect me, 0:04:04.880 --> 0:04:08.600 or you know, I'm not concerned. And I will tell 0:04:08.640 --> 0:04:13.760 you that whenever you hear about a case that is 0:04:13.880 --> 0:04:17.760 going to decide the future health and well being and 0:04:17.839 --> 0:04:22.200 safety of another community that you may not be a 0:04:22.240 --> 0:04:27.920 part of, you should pay attention because, like we've been saying, 0:04:28.839 --> 0:04:33.000 first they come for right the Martinia molar poem. First, 0:04:33.000 --> 0:04:36.840 they come for the low hanging fruit, the people that 0:04:36.920 --> 0:04:39.760 they think that no one cares about or that they 0:04:39.760 --> 0:04:44.880 will have common discrimination with, and that is trans people 0:04:44.920 --> 0:04:49.840 in this country. Because whether you speak with people in 0:04:49.920 --> 0:04:54.440 the black community, white folks, working class, Muslims, Christians, what 0:04:54.640 --> 0:04:59.400 have you. What there seems to be consensus around is 0:05:00.360 --> 0:05:06.320 transgender identity. So I want to provide a little bit 0:05:06.360 --> 0:05:11.000 of insight into this case. Why it matters so deeply 0:05:11.120 --> 0:05:16.880 to me, and what came up as I was reading 0:05:16.960 --> 0:05:21.400 and kind of putting together today's show is that America 0:05:22.279 --> 0:05:28.839 is obsessed with gender and gender roles and trans people. 0:05:28.960 --> 0:05:32.200 The reason why, folks, before I get into the case, 0:05:32.279 --> 0:05:37.640 the reason why there is all of this pushback and 0:05:37.839 --> 0:05:44.599 angst and discrimination and policies and weaponization of bathrooms is 0:05:44.680 --> 0:05:52.160 because I recognize, I believe that transgender people pose a 0:05:52.320 --> 0:05:59.960 threat to conservatives because if gender roles and gender see 0:06:00.040 --> 0:06:05.840 stereotypes no longer apply, then they lose their power. Then 0:06:05.960 --> 0:06:09.640 all of a sudden, we start talking about people as 0:06:09.760 --> 0:06:12.680 actual people and the roles that we want them to 0:06:12.760 --> 0:06:15.880 play in our partnerships, in our households and our families 0:06:16.200 --> 0:06:21.200 based on who that person is, not what their identity is. 0:06:21.960 --> 0:06:26.320 And what this all boils down to, folks, is about power, 0:06:26.520 --> 0:06:31.359 power over rather than power with. So what does it mean then 0:07:54.120 --> 0:07:58.400 for people to exist free in their own skin, in 0:07:58.480 --> 0:08:04.320 their own body and say that if my gender that 0:08:04.560 --> 0:08:08.480 was provided to me at birth does not match how 0:08:08.560 --> 0:08:11.000 I feel and who I am, and I'm saying to you, 0:08:11.760 --> 0:08:15.120 I'm telling you this is who I am. Why does 0:08:15.160 --> 0:08:19.640 anyone get to tell them? No? If I say my 0:08:19.800 --> 0:08:23.840 name is Danielle, refer to me as such, and then 0:08:23.880 --> 0:08:26.240 you turn around and tell me, well, you look like 0:08:26.280 --> 0:08:30.520 a Mary, so I'm gonna call you Mary. That's what this is about. But when you drill 0:09:08.960 --> 0:09:12.680 down to the fundamentals of what is at stake in 0:09:12.720 --> 0:09:19.360 this case, it is who gets to dictate their personhood 0:09:20.000 --> 0:09:23.720 the person who is telling you this is how I feel, 0:09:23.840 --> 0:09:27.240 this is who I am, or the other person living 0:09:27.280 --> 0:09:30.400 outside of that body that gets to tell you what 0:09:30.440 --> 0:09:32.800 you can and can't do with that body and how 0:09:32.840 --> 0:09:36.600 that body will be identified. It doesn't make any sense 0:09:37.160 --> 0:09:42.560 when it's said very plainly like that. The case was 0:09:42.640 --> 0:09:48.640 broad discrammatic case was brought by three trans youth and 0:09:48.720 --> 0:09:52.320 their parents last year, and they argue that the law 0:09:52.440 --> 0:09:57.360 violates the equal Protection clause of the fourteenth Amendment because 0:09:57.800 --> 0:10:01.920 of sex based discrimination. The decision in the case, which 0:10:01.960 --> 0:10:06.440 is expected in June, could have sweeping implications for trans 0:10:06.520 --> 0:10:09.840 youth across the country. According to the Human Rights Campaign, 0:10:10.679 --> 0:10:15.160 twenty six states have passed bans on gender affirming care, 0:10:15.320 --> 0:10:19.880 affecting thirty nine point four percent of trans youth in 0:10:19.920 --> 0:10:24.000 this country. So I want to unpack for a moment 0:10:25.120 --> 0:10:28.480 why this case is important and I want this is 0:10:28.960 --> 0:10:31.400 its very small print, but I want to offer it 0:10:31.520 --> 0:10:34.040 up to you also I will read it. This is 0:10:34.080 --> 0:10:38.920 about transgender or non binary youth having access to medically 0:10:39.040 --> 0:10:44.720 necessary care, services and treatments commonly provided to cisgender youth 0:10:45.240 --> 0:10:49.040 that their doctors have prescribed to them to treat their 0:10:49.120 --> 0:10:55.160 gender dysphoria and improve their physical, mental, and emotional wellbeing. 0:10:56.120 --> 0:11:01.760 Not having this care results in devastating consequences for their 0:11:01.840 --> 0:11:06.600 health and well being. This life saving care has been 0:11:06.600 --> 0:11:11.880 approved by the major medical associations and has been scientifically 0:11:12.000 --> 0:11:16.800 proven to be safe and effective. So, once again, friends, 0:11:17.160 --> 0:11:25.439 once again we have politicians playing doctor and telling us 0:11:25.960 --> 0:11:29.880 that those that actually went to medical school, those who 0:11:29.920 --> 0:11:34.720 actually have a degree in medicine, and are telling you 0:11:35.440 --> 0:11:40.160 that the care that is being issued for young trans 0:11:40.240 --> 0:11:46.840 youth is medically necessary and safe. Who are these politicians 0:11:46.840 --> 0:11:51.280 to come in and now say these doctors are wrong? 0:11:52.080 --> 0:11:58.280 So take it again, Roe v. Wade, nine unelected black 0:11:58.400 --> 0:12:03.840 robes got to DECI that women in this country, people 0:12:03.880 --> 0:12:09.080 with uteruses in this country no longer have bodily autonomy. 0:12:09.640 --> 0:12:13.559 For fifty years, abortion had been the law of the land, 0:12:14.440 --> 0:12:18.320 had been certified and safe because abortions are not just 0:12:18.520 --> 0:12:24.000 used for quote unquote unwanted pregnancies, they are also used 0:12:24.360 --> 0:12:29.160 as a part of reproductive care, full stop. And we 0:12:29.240 --> 0:12:34.200 are watching right now as women across the country that 0:12:34.240 --> 0:12:39.720 are in these red states are dying, are miscarrying, are 0:12:39.760 --> 0:12:43.760 bleeding out, are being forced to carry non viable pregnancies, 0:12:44.040 --> 0:12:48.640 and then listen as those babies gasp for air for 0:12:48.840 --> 0:12:54.040 hours before they die. When we said my body, my choice, 0:12:54.720 --> 0:12:58.120 it does not matter whether you are cisgender or transgender. 0:12:58.720 --> 0:13:02.400 It matters that you are and that you should have 0:13:02.440 --> 0:13:06.840 a say in your own goddamn life. And I just 0:13:07.120 --> 0:13:10.720 I woke up today and I said, my god, when 0:13:10.760 --> 0:13:16.160 will there come a time when humans are not being 0:13:16.280 --> 0:13:19.920 dictated to about who is human and who is not, 0:13:20.240 --> 0:13:23.680 who is deserving of dignity and who is not, Who 0:13:23.720 --> 0:13:27.240 should have life saving treatment and who shouldn't. Why is 0:13:27.320 --> 0:13:31.400 this something that is up for debate? And frankly, friends, 0:13:31.880 --> 0:13:35.600 if your life write it. If you don't know what 0:13:35.760 --> 0:13:40.520 it is like to wait with baited breath for nine 0:13:40.679 --> 0:13:45.600 unelected judges to decide your future, then you are a 0:13:45.720 --> 0:13:50.959 part of the oppressive class. You are the mainstream. Because 0:13:51.040 --> 0:13:57.480 my god, folks, from the fucking constitutional convention that decided 0:13:57.480 --> 0:14:00.800 that black people were only three fifths of human to 0:14:00.880 --> 0:14:04.960 the dread Scott decision to Plusy versus Ferguson, to Brown 0:14:05.040 --> 0:14:08.959 versus Board, to Roe v. Wade, to now the scrematic case, 0:14:09.320 --> 0:14:14.640 it is all the same. It is about the majority 0:14:15.280 --> 0:14:19.280 getting to dictate to the minority who is deserving and 0:14:19.360 --> 0:14:23.720 who is not. So all of a sudden, folks, the 0:14:23.800 --> 0:14:27.560 same conservatives that want to talk to you about parental 0:14:27.680 --> 0:14:30.480 rights and oh, your parents should have a right to 0:14:30.640 --> 0:14:33.280 say who gets to read what book and who gets 0:14:33.280 --> 0:14:37.040 to be in what curriculum, and parents writes, parents writes, Well, 0:14:37.080 --> 0:14:41.680 these parents of transgender youth are saying, we're listening to 0:14:41.760 --> 0:14:44.000 our kids, and our kids want the care, and our 0:14:44.080 --> 0:14:47.720 doctors say that the care is necessary because guess what 0:14:48.320 --> 0:14:51.880 they would rather their child be trans than dead. But 0:14:52.040 --> 0:14:56.760 politicians are telling you what you should be doing with 0:14:56.920 --> 0:15:02.360 your child. So conservatives want to have it multiple ways, 0:15:02.640 --> 0:15:05.040 not just two ways. They want to have it multiple ways. 0:15:06.120 --> 0:15:09.760 It's parents' rights so long as it is about taking 0:15:09.800 --> 0:15:13.640 other people's rights away and access away. But when it 0:15:13.720 --> 0:15:19.120 is about granting rights and listening to people and extending 0:15:19.640 --> 0:15:23.600 kindness and decency, then all of a sudden, politicians must 0:15:23.640 --> 0:15:28.040 intervene on your behalf because now parents don't know any better. 0:15:28.640 --> 0:15:35.360 This is the shit that is driving me crazy, and frankly, 0:15:35.440 --> 0:15:38.160 it should be driving all of us crazy. And you 0:15:38.280 --> 0:15:42.080 should not need to know somebody that is trans to 0:15:42.200 --> 0:15:45.480 give a damn about what the Supreme Court is doing 0:15:45.720 --> 0:15:49.560 and will decide with their six to three MAGA majority 0:15:50.120 --> 0:15:55.080 because it won't stop with trans folks. What will be next? 0:15:55.560 --> 0:15:59.560 And so here I want to read what would be 0:15:59.600 --> 0:16:03.480 the imp locations of this case and its decision. There 0:16:03.520 --> 0:16:07.360 are a range of different outcomes that are foreseeable in 0:16:07.400 --> 0:16:11.000 a final ruling. A ruling in favor of the families 0:16:11.240 --> 0:16:14.240 would return the case to the lower courts to apply 0:16:14.400 --> 0:16:19.960 the appropriate standard of review for improper sex based classifications. 0:16:20.480 --> 0:16:24.000 If the court upholds the ban, the Tennessee law would 0:16:24.000 --> 0:16:30.080 remain in effect, depriving transminers from receiving hormone therapy, green 0:16:30.160 --> 0:16:34.840 lighting similar bands already enacted in other states twenty six 0:16:35.640 --> 0:16:40.800 and potentially emboldening even more states to pass similarly restrictive 0:16:40.880 --> 0:16:45.960 laws and perhaps even more draconian bands. However, this case 0:16:46.040 --> 0:16:49.920 is decided, it is likely to have significant impact on 0:16:50.040 --> 0:16:54.200 how much deference courts give to bands on medical care 0:16:54.560 --> 0:17:01.680 to treat gender dysphoria. Folks. Then, what's next, I'll tell 0:17:01.720 --> 0:17:06.840 you what comes next. What comes next will be birth control. 0:17:07.520 --> 0:17:12.320 It'll start with youth. Oh, women, girls under a certain 0:17:12.359 --> 0:17:17.000 age can't receive birth control, right, which already happens in 0:17:17.040 --> 0:17:20.480 some states. I'm sure of it. You need parental consent. 0:17:20.640 --> 0:17:23.840 Da Da Da da da. Then they'll say, well, no, 0:17:23.840 --> 0:17:26.520 now you don't need parental consent. We're saying that no 0:17:26.560 --> 0:17:31.960 one under the age of say, seventeen eighteen will be 0:17:32.000 --> 0:17:37.040 able to access birth control. You'll let these things enter. 0:17:37.920 --> 0:17:44.520 When do they end it's transgender youth today, it's SIS 0:17:44.560 --> 0:17:49.200 youth tomorrow, and then it's all of us. And when you look at the numbers, folks, 0:17:54.160 --> 0:17:59.160 because this is something that is also incredibly important, transgender 0:17:59.240 --> 0:18:05.120 youth report its significantly increased rates of depression and victimization 0:18:05.400 --> 0:18:10.240 compared to their cisgender peers. Notably, in the past year, 0:18:10.520 --> 0:18:15.399 one in three transgender youth reported attempted suicide. Folks, listen 0:18:15.480 --> 0:18:19.880 to this. Let me say that again. Notably, in the 0:18:19.960 --> 0:18:27.280 past year, one in three transgender youth reported attempting suicide, 0:18:27.320 --> 0:18:31.400 almost one third reported being a victim of sexual violence, 0:18:31.680 --> 0:18:37.280 and more than half reported a two week period of depression. Folks, 0:18:37.359 --> 0:18:42.000 how is this okay? Seriously considering suicide in the past year, 0:18:42.280 --> 0:18:47.560 sixteen percent of cisgender youth, while forty four percent of 0:18:47.640 --> 0:18:51.800 trans youth felt sad or hopeless for two weeks or more. 0:18:51.840 --> 0:18:56.040 In the past year, thirty percent of cisgender kids, fifty 0:18:56.160 --> 0:19:01.080 three percent of trans kids. This should not be acceptable. 0:19:01.920 --> 0:19:06.440 And so when you hear that this case is happening, 0:19:07.160 --> 0:19:09.959 and I will tell you that Chase Strangio, who is 0:19:10.000 --> 0:19:14.280 the lawyer for ACLU, who is also on the team 0:19:14.320 --> 0:19:19.439 presiding over this case is the first openly transperson to 0:19:19.720 --> 0:19:24.160 argue before the Supreme Court and use his own life 0:19:24.880 --> 0:19:30.159 and the life saving hormones and therapy and medical intervention 0:19:30.280 --> 0:19:34.000 that he received that allows him to be standing before 0:19:34.040 --> 0:19:40.480 the Supreme Court to argue for the ability of trans 0:19:40.600 --> 0:19:45.439 youth to have a future, because that is what this 0:19:45.640 --> 0:19:50.600 is about. We do not know what it is like 0:19:51.600 --> 0:19:54.879 to exist inside of a body that you feel like 0:19:55.080 --> 0:19:58.439 is betraying you on a day to day basis, to 0:19:58.560 --> 0:20:03.439 be victimized, to be her rest. Just this week, Model 0:20:03.480 --> 0:20:08.199 of the Year was given to a trans model. You 0:20:08.280 --> 0:20:15.080 see folks like Laverne Cox, transactress. You see people in 0:20:15.200 --> 0:20:18.320 prominent positions and you want to believe that we are 0:20:18.359 --> 0:20:21.600 headed in the right direction. But folks, we are not. 0:20:22.400 --> 0:20:27.280 Those people are the exception, not the rule. After the election, 0:20:27.600 --> 0:20:31.439 the Trevor Project where I got this data from. The 0:20:31.480 --> 0:20:39.879 Trevor Project is an LGBTQ organization that works to decrease 0:20:40.880 --> 0:20:47.440 suicide and mental health issues that regularly plague the LGBTQ community. 0:20:47.960 --> 0:20:53.040 They have a hotline and that hotline folks had a 0:20:53.200 --> 0:20:59.000 six hour wait following the election because the youth, the 0:20:59.119 --> 0:21:05.360 queer youth of this country watched as America voted against them. 0:21:05.560 --> 0:21:09.960 They are watching as folks like Nancy Mace put into 0:21:10.080 --> 0:21:14.919 effect bathroom bands for a duly elected member of Congress 0:21:15.600 --> 0:21:20.840 to embarrass her. Our children are watching, and what we 0:21:20.920 --> 0:21:24.840 are showing them is that their lives do not matter. 0:21:25.800 --> 0:21:29.960 I remember and I participated in that It Gets Better 0:21:30.040 --> 0:21:34.520 campaign in the early two thousands because there had been 0:21:34.960 --> 0:21:41.639 a rash of high profile suicides of young queer kids 0:21:41.880 --> 0:21:45.200 who were being bullied to death and who were going 0:21:45.240 --> 0:21:49.200 home and they were hanging themselves, they were cutting themselves, 0:21:49.960 --> 0:21:57.320 and a bunch of queer adults, celebrities, advocates, activists started 0:21:57.359 --> 0:22:00.399 that it Gets Better project to show them that life 0:22:00.440 --> 0:22:04.480 gets better. To hang in there. School. Maybe Top high 0:22:04.520 --> 0:22:07.000 school may be rough, but like you will make it 0:22:07.000 --> 0:22:09.160 to the other side. You can get married, you can 0:22:09.440 --> 0:22:13.000 be successful, you can find love even if it is 0:22:13.040 --> 0:22:18.119 not in your home.
