The Chevrolet Trailblazer was a vehicle 0:19:18.880 --> 0:19:23.360 that was in the line at Wendy's on the night 0:19:23.400 --> 0:19:28.280 of this incident and it received a shot from Officer 0:19:28.400 --> 0:19:32.280 Roth's gun. We've had an opportunity, along with the GBI 0:19:32.480 --> 0:19:38.199 now to view that trailblazer. My office has had an 0:19:38.240 --> 0:19:43.800 opportunity to inspect the crime scene. We have conducted a 0:19:43.920 --> 0:19:48.560 canvas of the area. We started our investigation at about 0:19:48.640 --> 0:19:53.000 one fifteen am on Saturday morning, and we have been 0:19:53.000 --> 0:19:57.000 working on this case around the clock since that time. 0:19:57.480 --> 0:20:01.840 Because of the next line, we have spent some time 0:20:02.080 --> 0:20:07.720 examining the taser evidence in this case. This will be 0:20:51.680 --> 0:20:56.720 the fourth time that we have asked that arrest warrants 0:20:56.880 --> 0:21:01.040 or issued in a case before an indictment. Unfortunately, 0:21:10.560 --> 0:21:16.600 this marks the fortieth prosecution of police officers from misconduct 0:21:17.320 --> 0:21:21.399 here in our county, and this is the ninth time 0:21:21.480 --> 0:21:26.520 that we've prosecuted a homicide case committed by a police officer. 0:21:27.520 --> 0:21:31.720 Eight of those cases involved black males, and one of 0:21:31.720 --> 0:21:38.600 those cases involved a black female. So in reaching our decision, 0:21:39.240 --> 0:21:45.360 there were some considerations that we considered important and one 0:21:45.359 --> 0:21:50.760 of the things that we noted from our evaluation was 0:21:50.800 --> 0:21:54.639 that mister Brooks on the night of this incident was calm, 0:21:55.840 --> 0:22:02.840 He was cordial and really displayed a cooper prative nature. Secondly, 0:22:02.960 --> 0:22:09.080 even though mister Brooks was slightly impaired, his demeanor during 0:22:09.119 --> 0:22:16.879 this incident was almost jovial. Also, we noted that he 0:22:16.960 --> 0:22:21.840 received many instructions from the Atlanta officers and he was 0:22:21.880 --> 0:22:26.119 asked many questions. Some of the questions he was asked repeatedly, 0:22:26.880 --> 0:22:30.960 but for forty one minutes in seventeen seconds, he followed 0:22:30.960 --> 0:22:37.439 every instruction, he answered the questions. The fourth thing we 0:22:37.560 --> 0:22:42.679 noted is that mister Brooks was never informed that he 0:22:42.800 --> 0:22:47.000 was under arrest for driving under the influence, and this 0:22:47.080 --> 0:22:50.520 is a requirement of the Atlanta Police Department. When one 0:22:50.680 --> 0:22:55.480 is charged with the DUI. The Atlanta Police Department's own 0:22:55.600 --> 0:23:01.520 procedures required that that person is informed immediately that they 0:23:01.600 --> 0:23:06.240 are under arrest. And then he was and then he 0:23:06.440 --> 0:23:12.000 was grabbed from the rear by Officer Roth, who made 0:23:12.040 --> 0:23:16.320 an attempt to physically restrain him. After the forty one 0:23:16.359 --> 0:23:23.000 minute and seventeen second discussion, we concluded and considered it 0:23:23.119 --> 0:23:29.320 as one of our important considerations that mister Brooks never 0:23:29.560 --> 0:23:35.000 presented himself as a threat. At the very beginning, he 0:23:35.080 --> 0:23:39.600 was peacefully sleeping in his car. After he was awakened 0:23:39.600 --> 0:23:44.920 by the officer, he was cooperative and he was directed 0:23:45.000 --> 0:23:48.600 to move his car to another location. He calmly moved 0:23:48.640 --> 0:23:51.919 his car. Mister Brooks was asked whether or not he 0:23:51.960 --> 0:23:56.600 had a weapon, He indicated that he did not. Without 0:23:56.640 --> 0:24:01.040 any resistance. He passed his driver's license to the officers, 0:24:01.760 --> 0:24:05.640 and the officers then asked mister Brooks whether or not 0:24:05.840 --> 0:24:09.960 he would consent to a pat down a body search, 0:24:10.520 --> 0:24:14.199 and mister Brooks allowed them to search him, and the 0:24:14.280 --> 0:24:17.879 search yielded no weapon. We found that it was of 0:24:17.960 --> 0:24:23.080 interest that when the officers patted mister Brooks down they 0:24:23.160 --> 0:24:26.200 noticed there was a bulge in his pants. They did 0:24:26.240 --> 0:24:28.840 not pull that item out of his pocket. They took 0:24:28.880 --> 0:24:33.760 mister Brookes's word that that bulge represented a number of 0:24:34.040 --> 0:24:41.119 dollar bills. But mister Brooks never displayed any aggressive behavior 0:24:41.840 --> 0:24:48.480 during the seventy forty one minutes in seventeen seconds. Now, 0:24:48.800 --> 0:24:55.760 this is another important consideration that we discovered as we 0:24:55.840 --> 0:25:01.480 evaluated this case. Once mister Brooks was shot, there is 0:25:01.520 --> 0:25:07.600 in Atlanta policy that requires that the officers have to 0:25:07.640 --> 0:25:13.520 provide timely medical attention to mister Brooks already anyone who 0:25:13.600 --> 0:25:17.240 is injured. But after mister Brooks was shot, for some 0:25:17.400 --> 0:25:23.359 period of two minutes and twelve seconds, there was no 0:25:23.840 --> 0:25:29.919 medical attention applied to mister Brooks. But when we examined 0:25:29.960 --> 0:25:35.080 the video tape and in our discussions with witnesses, what 0:25:35.119 --> 0:25:39.800 we discovered is during the two minutes and twelve seconds 0:25:39.840 --> 0:25:45.400 that Officer Roff actually kicked mister Brooks while he laid 0:25:45.440 --> 0:25:50.520 on the ground while he was there fighting for his life. Secondly, 0:25:50.720 --> 0:25:54.040 from the videotape, we were able to see that the 0:25:54.119 --> 0:26:01.440 other officer, Officer Broslan, actually stood on mister Brooks's shoulders 0:26:01.440 --> 0:26:07.320 while he was there struggling for his life. We were 0:26:07.359 --> 0:26:11.919 able to conclude that, based on the way that these 0:26:11.960 --> 0:26:17.080 officers conducted themselves while mister Brooks was lying there, that 0:26:17.240 --> 0:26:22.320 the demeanor of the officers immediately after the shooting did 0:26:22.400 --> 0:26:28.560 not reflect any fear or danger of mister Brooks, but 0:26:28.600 --> 0:26:35.440 their actions really reflected other kinds of emotions. So as 0:26:35.880 --> 0:26:42.359 we are drawing our legal conclusion in this case, we 0:26:42.359 --> 0:26:46.439 were led by the two foundational cases in this matter, 0:26:47.359 --> 0:26:51.520 one being Tennessee versus Garner, and what that case points 0:26:51.520 --> 0:26:56.600 out is when an officer is pursuing a fleeing suspect, 0:26:57.200 --> 0:27:02.360 that the officer may not use force to prevent escape 0:27:02.480 --> 0:27:07.080 unless the officer has probable cause to believe that the 0:27:07.160 --> 0:27:13.639 suspect poses an immediate threat of death or of serious 0:27:13.640 --> 0:27:19.520 physical injury to that officer.
