That this idea of the administrative state was introduced, 0:40:40.760 --> 0:40:44.360 you know, at least theoretically by Woodrow Wilson. He thought 0:40:44.360 --> 0:40:47.319 that there should be this this class of neutral bureaucrats 0:40:47.320 --> 0:40:49.640 that ran our federal government. I personally don't believe that 0:40:49.680 --> 0:40:51.600 there can be someone who is politically neutral. I think 0:40:51.600 --> 0:40:55.200 everyone has an opinion. Then LBJ and FDR expanded this 0:40:55.239 --> 0:40:59.000 administrative state. So now we have this bloated, this bloated apparatus, 0:40:59.040 --> 0:41:01.960 which a lot of people called the deep state because 0:41:01.960 --> 0:41:04.960 of all these politicos that work there that aren't accountable 0:41:04.960 --> 0:41:07.560 to the voter. In my opinion, and I want your 0:41:07.600 --> 0:41:10.400 take as a constitutional lawyer on this. It's it's it's it's the EPA that 0:42:28.360 --> 0:42:30.840 did it. It's it's it's the agency. It's OSHA that 0:42:30.920 --> 0:42:34.680 did it. But secondly, there's a problem that we've seen 0:42:34.800 --> 0:42:38.680 that's called regulatory capture. And this is a notion from economics, 0:42:38.719 --> 0:42:42.360 where you have regulators that are regulating in particular industry 0:42:42.400 --> 0:42:45.719 who become captured by it. They have a revolving door 0:42:45.800 --> 0:42:48.520 where people come from the agency to the to the 0:42:48.680 --> 0:42:51.839 private sector that they're regulating, and back again, and they 0:42:51.920 --> 0:42:56.839 end up following the interests of the giant companies in 0:42:56.880 --> 0:43:00.239 that industry. So you see it in the aviation world 0:43:00.280 --> 0:43:02.680 with the FAA and a company like Boeing, and you 0:43:02.680 --> 0:43:04.640 look at the seven thirty seven macs where there was 0:43:04.680 --> 0:43:09.080 an instance the FAA was not remotely effective enough and 0:43:09.200 --> 0:43:12.239 ensuring the safety of the seven thirty seven macs. With 0:43:12.280 --> 0:43:15.440 respect to COVID. You look at the FDA and just 0:43:15.560 --> 0:43:18.600 how in bad the FDA is With Big Pharma. Wade, We've talked about decisions that are obviously 0:44:38.840 --> 0:44:42.600 unconstitutional that the left, there are judicial activists who actually 0:44:42.640 --> 0:44:47.000 don't want to overturn a demonstrably wrong and unconstitutional decision 0:44:47.040 --> 0:44:50.879 just because it's been quote unquote settled for decades. So 0:44:51.239 --> 0:44:54.319 I don't understand that jurisprudence, if you want to call 0:44:54.360 --> 0:44:57.640 it a jurisprudence.
