And I say that because I argued 0:09:26.840 --> 0:09:30.640 lots of appeals in military appellate courts and civilian in 0:09:30.800 --> 0:09:35.600 local appellate courts and federal federal court. Judges usually use 0:09:35.760 --> 0:09:41.360 gentle euphemisms when they're criticizing what a lower court judge did. 0:09:41.840 --> 0:09:43.839 You know, man, you know, perhaps the judge could have 0:09:44.040 --> 0:09:48.360 exercised different discretion. That's not what this panel did. This 0:09:48.559 --> 0:09:53.560 panel said, basically, Judge Cannon abused her discretion by even 0:09:53.760 --> 0:09:59.720 exercising jurisdiction and deciding to order the Department of Justice 0:09:59.760 --> 0:10:04.520 the FBI to stop criminally investigating Donald Trump as his 0:10:04.720 --> 0:10:09.520 conduct pertains to these classified documents that were seized from 0:10:09.600 --> 0:10:13.439 Mara Lago. And when courts just flat out say judges 0:10:13.880 --> 0:10:19.280 abuse their discretion and shouldn't have even exercised the courts jurisdiction, 0:10:19.400 --> 0:10:22.120 what they are saying is, Judge Cannon, you are not 0:10:22.440 --> 0:10:25.559 very good at this judging thing. Our faith in the 0:10:37.240 --> 0:10:41.079 federal judiciary is at an all time low because our 0:10:41.120 --> 0:10:46.040 federal courts are now populated with unqualified judges that Donald 0:10:46.080 --> 0:10:48.719 Trump and Mitch McConnell crammed down the throats of the 0:10:48.800 --> 0:10:54.800 American people right and a lean Cannon was confirmed by 0:10:54.880 --> 0:11:00.160 Mitch McConnell Senate after Donald Trump lost the election. The 0:11:00.280 --> 0:11:03.800 opinion she issued saying things in essence like Donald, I 0:11:03.880 --> 0:11:06.880 treat Donald Trump differently than I treat every other litigan 0:11:07.040 --> 0:11:09.960 before the court. That is a violation of her oath, 0:11:10.080 --> 0:11:13.400 quite frankly. And we'll see if she's referred for potential 0:11:13.520 --> 0:11:17.640 judicial misconduct. But because our faith in the federal bench 0:11:18.000 --> 0:11:21.319 is at an all time low, I was holding my 0:11:21.440 --> 0:11:25.520 breath waiting to see how Trump appointed judges might deal 0:11:25.640 --> 0:11:29.199 with this, and I was so thrilled to see that 0:11:29.640 --> 0:11:34.239 two of the three judges Trump appointees not only decided 0:11:34.360 --> 0:11:37.880 this at light speed because they got a forty page 0:11:38.000 --> 0:11:42.319 brief from Donald Trump's criminal defense team on Tuesday. On Wednesday, 0:11:42.600 --> 0:11:46.640 they said, you lose. That's light speed for an appellate court. 0:11:47.520 --> 0:11:51.480 And then the other thing that I'm really pleased about 0:11:51.720 --> 0:11:54.560 is Judge Deerie in New York, who's the special Master 0:11:54.720 --> 0:11:58.040 reviewing us. It was a Ronald Reagan appointee. So what 0:11:58.240 --> 0:12:02.920 we have our republic judges, federal court judges who are 0:12:03.080 --> 0:12:07.319 basically the adults in charge once again as opposed to 0:12:07.400 --> 0:12:11.600 the alien canons, and they are taking this deadly seriously. 0:12:11.679 --> 0:12:15.480 The need to investigate Donald Trump's crimes and the need 0:12:15.559 --> 0:12:19.480 to protect our national security and assess the damage Donald 0:12:19.520 --> 0:12:24.280 Trump did to our national security by stealing and then 0:12:24.480 --> 0:12:29.240 unlawfully concealing these classified documents. And I thought that that 0:13:11.720 --> 0:13:18.520 was so glaring because in the Cannon decision, it was 0:13:18.960 --> 0:13:21.319 we're just going to take this on a matter of 0:13:21.600 --> 0:13:25.839 Donald Trump said it, so it must be true, and 0:13:26.080 --> 0:13:30.560 we must take what this former twice impeached lying president 0:13:30.679 --> 0:13:35.320 has said over our Department of Justice, essentially signaling, well, 0:13:35.360 --> 0:13:38.160 he could be right. You know what that is. And you know, there's a body of case 0:18:11.760 --> 0:18:18.400 law that says when suits are brought, and these suits 0:18:19.040 --> 0:18:25.880 involve matters of grave national security, the courts generally will defer, 0:18:26.680 --> 0:18:31.199 you know, appropriately, but will defer to the federal government 0:18:31.440 --> 0:18:36.960 to the intelligence communities assessment of the possible risks to 0:18:37.119 --> 0:18:41.680 national security. And the Supreme Court has supported that over 0:18:41.800 --> 0:18:44.399 and over and over again. And Judge Cannon was like, 0:18:44.680 --> 0:18:47.040 I don't care about any of that. I'm treating Donald 0:18:47.080 --> 0:18:50.679 Trump differently. And you know, I called her a classified 0:18:50.760 --> 0:18:53.840 documents denier. She said, I don't even know that. I'm 0:18:53.880 --> 0:18:56.120 not prepared to take this is what she said.
