Penry had brain damage from 1:06:30.080 --> 1:06:33.080 birth related to being breach, which is when the baby's head, 1:06:33.320 --> 1:06:35.840 the baby tries to come out feet first. And his 1:06:35.960 --> 1:06:39.800 mother also suffered from schizophrenia and treated him horribly and 1:06:39.880 --> 1:06:42.400 was abusive. She burned him in a scalding bath, locked 1:06:42.440 --> 1:06:44.240 him in his room for long periods of time without 1:06:44.240 --> 1:06:47.240 food or water, and he was allegedly forced to drink 1:06:47.280 --> 1:06:50.440 his own urine and eat his own feces. Horrible, his 1:06:50.560 --> 1:06:53.840 sister said in court documents, quote we were all abused, 1:06:53.840 --> 1:06:55.840 but he was abused the worst. She would beat him 1:06:55.840 --> 1:06:58.160 with anything in sight. She would threaten to gouge his 1:06:58.200 --> 1:07:00.680 eyeballs out with her long fingernails. She would threaten to 1:07:00.720 --> 1:07:02.440 cut off his privates with a butcher knife. 1:07:02.520 --> 1:07:03.160 End quote. 1:07:03.520 --> 1:07:06.440 So this guy, Johnny Paul Penry, only went through first 1:07:06.440 --> 1:07:09.640 grade of education when he was nine. His IQ was 1:07:09.640 --> 1:07:13.600 fifty six, according to a state psychologist report, and according 1:07:13.600 --> 1:07:16.760 to the report, it said, quote Johnny seems so seriously 1:07:16.760 --> 1:07:20.200 impaired that he is incapable of intellectually functioning at anything 1:07:20.320 --> 1:07:23.280 like an age appropriate level. So at twelve, he was 1:07:23.320 --> 1:07:27.400 institutionalized at the Mexia State School for the Mentally Retarded. 1:07:28.080 --> 1:07:31.200 According to a school report, the school noticed many small 1:07:31.240 --> 1:07:33.440 scars on Johnny's head, when they gave him a haircut, 1:07:33.480 --> 1:07:35.280 and Johnny said they were from a belt buckle when 1:07:35.280 --> 1:07:37.840 his mom would beat him. At fifteen, he was given 1:07:37.840 --> 1:07:40.240 a reading test where he had to match drawings to words. 1:07:40.600 --> 1:07:43.000 He identified a door as a dress, a chicken as 1:07:43.040 --> 1:07:45.320 a drum, a hat as a flag. So this guy 1:07:45.400 --> 1:07:50.120 has very very low intellectual capacity. And in nineteen seventy seven, 1:07:50.760 --> 1:07:56.240 Henry attacks a woman and rapes her. State psychiatrists found 1:07:56.240 --> 1:07:58.840 that he was still a bedwetter and that his judgment 1:07:58.920 --> 1:08:01.360 was quote severely and then he had little regard for 1:08:01.440 --> 1:08:04.240 others or even himself. Penry said he didn't mean to 1:08:04.360 --> 1:08:06.240 hurt the woman, but the doctor wrote in his report 1:08:06.320 --> 1:08:08.880 quote he had never had a woman before, and he 1:08:08.920 --> 1:08:10.960 wanted to see what that would be like. End quote. 1:08:11.360 --> 1:08:15.880 So for this crime he only serves two years. So 1:08:15.920 --> 1:08:18.640 he gets out and he gets a job delivering appliances. 1:08:19.240 --> 1:08:23.439 Three months after getting out in nineteen seventy nine. October 1:08:23.439 --> 1:08:26.240 of nineteen seventy nine, Henry rapes and kills a twenty 1:08:26.240 --> 1:08:29.839 two year old woman named Pamela Moseley Carpenter by stabbing 1:08:29.840 --> 1:08:32.559 her with a pair of scissors. He had delivered something 1:08:32.560 --> 1:08:35.000 to her a few weeks before. So then he broke 1:08:35.040 --> 1:08:37.640 into her house while she was decorating it, beat and 1:08:37.720 --> 1:08:40.720 raped her, and then left her to die. She eventually 1:08:40.760 --> 1:08:43.280 died from internal bleeding, but before she did, she described 1:08:43.280 --> 1:08:46.320 her attacker in the ambulance. So Penry was arrested by 1:08:46.360 --> 1:08:48.840 police on the same day. He was sentenced to death 1:08:48.880 --> 1:08:51.240 in April of nineteen eighty just a few months later, 1:08:51.520 --> 1:08:54.719 and his case set off a huge nationwide discussion about 1:08:54.720 --> 1:08:59.599 the idea of executing intellectually disabled offenders. So in nineteen 1:08:59.600 --> 1:09:01.400 eighty nine, and his case went all the way to 1:09:01.439 --> 1:09:04.519 the Supreme Court and it was called Penry versus Lineow, 1:09:05.080 --> 1:09:08.599 and the Court held that the execution of intellectually disabled 1:09:08.600 --> 1:09:12.559 defenders did not constitute cruel and unusual punishment. I don't 1:09:12.600 --> 1:09:14.840 know how, but you know, the Supreme Court does a 1:09:14.880 --> 1:09:17.599 lot of fucked up stuff. But they did overturn his 1:09:17.640 --> 1:09:20.839 death sentence, saying that the jury had not been allowed 1:09:20.880 --> 1:09:25.200 to properly consider his intellectual disability as a mitigating evidence 1:09:25.320 --> 1:09:28.759 during the punishment phase of the trial. So in nineteen ninety, 1:09:28.960 --> 1:09:31.679 this goes on forever. In nineteen ninety he's tried again, 1:09:32.040 --> 1:09:34.760 and again he's sentenced to death. In two thousand and one, 1:09:35.360 --> 1:09:37.559 that nineteen ninety conviction is appealed to the U. S 1:09:37.560 --> 1:09:40.240 Supreme Court. According to his lawyer, he says he 1:11:27.960 --> 1:11:30.080 still believes in Santa Claus. And this is from a 1:11:30.120 --> 1:11:32.840 New York Times article that was released a few days 1:11:32.840 --> 1:11:37.200 before one of his scheduled executions. And so he is 1:11:37.240 --> 1:11:39.519 still incarcerated as far as I know. And of the 1:11:39.560 --> 1:11:42.840 thirty eight states that have capital punishment, thirteen bar the 1:11:42.880 --> 1:11:47.479 execution of the mentally it says the mentally retarded. What 1:11:47.560 --> 1:11:50.840 I looked up as does federal law. People are classified 1:11:50.960 --> 1:11:54.559 as mentally disabled if their IQs are below seventy and 1:11:54.560 --> 1:11:57.080 they have an inability to adapt to daily life.
