So 1:35:58.200 --> 1:36:01.439 the Department of Justice opened in an investigation, which served 1:36:01.439 --> 1:36:05.040 as the first time Asian Americans were protected as like 1:36:05.360 --> 1:36:08.080 you know, like as a hate crime situation and viewed 1:36:08.120 --> 1:36:11.760 as a protected class. So then it was acceptable to 1:36:11.840 --> 1:36:14.240 like that it like because of their Asian ness is 1:36:14.280 --> 1:36:17.639 what impeded on his civil rights because it with double jeopardy, 1:36:17.680 --> 1:36:21.000 they can't like go back for that case, like I'm 1:36:21.120 --> 1:36:24.160 you know, this gets kind of complicated. But the federal 1:36:24.200 --> 1:36:27.519 grand jury indicted Ebans and Knits on two counts of 1:36:27.600 --> 1:36:30.080 interfering with Vincent Chin's right to be in a place 1:36:30.080 --> 1:36:34.519 of public accommodation and conspiring to do so. The two 1:36:34.560 --> 1:36:36.600 of them kept claiming that race had nothing to do 1:36:36.680 --> 1:36:40.240 with it, but the jury in Detroit did disagree, like 1:36:40.280 --> 1:36:43.519 the grand jury, and so in June nineteen eighty four, 1:36:43.640 --> 1:36:46.519 Ebans was found guilty of interfering which in civil rights, 1:36:46.520 --> 1:36:49.519 but not guilty of conspiracy, and Knits was found not 1:36:49.560 --> 1:36:53.240 guilty on both charges. So in nineteen eighty four, the 1:36:53.360 --> 1:36:56.759 US District Court sentenced Ebans to twenty five years in prison, 1:36:57.400 --> 1:36:59.760 but he was released two years later because of him 1:37:00.160 --> 1:37:04.840 like an improper prosecution, witness coaching like so whatever, you know, 1:37:04.880 --> 1:37:07.800 appeals court, appeals court. It became successful because of the 1:37:07.920 --> 1:37:11.439 errors that the government made during the first trial. So 1:37:11.479 --> 1:37:15.439 then they tried to do a new trial and retry him, 1:37:15.720 --> 1:37:19.800 and the trial was moved to Cincinnati, and Cincinnati the 1:37:19.880 --> 1:37:23.040 jury was you know, like just like Eban's white male, 1:37:23.120 --> 1:37:26.640 blue collar and cleared Ebans of all charges in a 1:37:26.720 --> 1:37:29.160 civil suit though he was ordered to pay one point 1:37:29.200 --> 1:37:33.160 five million dollars to the chin estate and with interest 1:37:33.240 --> 1:37:36.040 in all these years, it's up to like eight million dollars, 1:37:36.120 --> 1:37:38.320 but he will not pay it. He lives paycheck to paycheck and like just refuses. 1:37:43.280 --> 1:37:45.640 And he was basically begging for the lean on his 1:37:45.640 --> 1:37:48.479 home in Nevada to be removed. But you still owe money, 1:37:48.520 --> 1:37:50.679 so you can't. So basically like what the lien means, 1:37:50.680 --> 1:37:52.640 he cannot rent or sell this home that he lives in. 1:37:53.000 --> 1:37:55.800 But he purposely moved to Nevada because of their like 1:37:55.840 --> 1:37:59.439 a homestead act and he thought it would like help 1:37:59.520 --> 1:38:04.559 him not have to pay this and also then tried 1:38:04.680 --> 1:38:07.720 to set a motion to ask for the family to 1:38:07.760 --> 1:38:12.320 pay for his attorney's fees psycho, but his house wasn't 1:38:12.360 --> 1:38:14.840 worth enough to get this whatever act this is. 1:38:15.360 --> 1:38:17.479 He was too poor for it. So he still owes money. 1:38:17.479 --> 1:38:18.240 He has to stay there. 1:38:18.240 --> 1:38:20.360 He cannot sell it or rent it or anything, and 1:38:20.400 --> 1:38:22.400 they're supposed to get money, but he goes whatever. It is beyond outrageous that this 1:38:59.800 --> 1:39:03.599 un remorseful killer is suing for attorney's fees that would 1:39:03.600 --> 1:39:07.280 allow him to continue evading payment for beating Vincent Chin 1:39:07.439 --> 1:39:09.519 to death twenty three years ago. 1:39:09.800 --> 1:39:10.839 So the case did. 1:39:10.760 --> 1:39:14.679 Expose like this fucked up thing that happened with the judge. 1:39:14.720 --> 1:39:18.640 And basically, now for manslaughter cases in Michigan, there's a 1:39:18.640 --> 1:39:22.440 mandatory minimum sentence guideline and the state Supreme Court adopted 1:39:22.479 --> 1:39:26.160 this and put it into state legislator legislature. 1:39:27.040 --> 1:39:27.880 So basically the. 1:39:27.800 --> 1:39:31.400 Guidelines say a judge could issue a sentence below the minimum, 1:39:31.400 --> 1:39:34.360 but they have to give reason why, like specific reason. 1:39:34.800 --> 1:39:36.960 So this judge was just able to be like, never mind, 1:39:37.000 --> 1:39:40.360 these guys are good, go on probation, and now you 1:39:40.560 --> 1:39:43.320 for a manslaughter, you have to give the minimum or 1:39:43.360 --> 1:39:46.439 the judge has to prove and explain why they're not 1:39:46.520 --> 1:39:48.920 giving the minimum, which I can't believe. 1:39:48.920 --> 1:39:50.120 This has to be a rule. 1:39:51.120 --> 1:39:54.080 This case also helped ensure that victims and future cases 1:39:54.120 --> 1:39:57.680 would be represented during sentencing and court proceedings.
