So it's a crisis, and how 0:38:47.160 --> 0:38:49.640 do we how should we handle this crisis? So the status right now, and 0:40:03.160 --> 0:40:05.440 I think that there's a lot of a lot of 0:40:05.440 --> 0:40:07.839 people are reporting on what they want to report on 0:40:07.920 --> 0:40:12.040 here and not necessarily what's really going on. The status 0:40:12.120 --> 0:40:16.239 right now is if you show up from any foreign country, 0:40:16.280 --> 0:40:18.960 if you show up at a southern border with somebody 0:40:18.960 --> 0:40:21.759 who is a minor, what do you have to do 0:40:21.960 --> 0:40:24.640 to get into the country? And I mean, who's being 0:40:24.680 --> 0:40:27.719 turned away in that situation. Is anyone being turned away 0:40:27.719 --> 0:40:32.000 in that situation right away? Well, what's supposed to happen 0:40:32.120 --> 0:40:35.160 is that they're supposed to be processed for expedited removal. 0:40:35.160 --> 0:40:39.520 And as that sounds, they don't appear before an immigration 0:40:39.640 --> 0:40:44.399 judge and immigration officer makes the determination, we get them 0:40:44.400 --> 0:40:46.879 travel documents, and we send them back home. That's how 0:40:46.880 --> 0:40:50.320 it's supposed to work. But if you claim credible fear, 0:40:51.040 --> 0:40:54.600 then you get to have an interview with an asylum officer. 0:40:54.680 --> 0:40:57.040 And about eighty nine percent of all aliens who are 0:40:57.040 --> 0:41:00.680 interviewed by asylum officers are found to have a credible fear. 0:41:00.840 --> 0:41:03.600 It's very low standards, lower than the standard for asylum 0:41:03.680 --> 0:41:09.839 well founded fear of persecution. And so consequently eighty nine 0:41:09.840 --> 0:41:13.440 percent of all the people who claim credible fear are 0:41:13.480 --> 0:41:15.560 admitted to the United States, so that can apply for 0:41:15.600 --> 0:41:17.960 asylum before an immigration judge. But at the end of 0:41:17.960 --> 0:41:22.520 the day, nationals of those three countries El Salvador, Honduras, 0:41:22.520 --> 0:41:26.120 Guatemala last year in FY two and eighteen, nine percent 0:41:26.200 --> 0:41:29.359 of those asylum claims were actually granted. So eighty nine 0:41:29.400 --> 0:41:32.640 percent we're found to have credible fear, nine percent got asylum. 0:41:33.120 --> 0:41:36.719 That's a huge disconnect that is allowing these folks into 0:41:36.760 --> 0:41:39.160 the United States. And again, these tearings can take up 0:41:39.160 --> 0:41:41.400 to eight years to be done. We do we have 0:41:41.480 --> 0:41:44.399 good numbers are on what So what you just told 0:41:44.400 --> 0:41:46.239 me is that of the people who claim credible fear, 0:41:46.320 --> 0:41:51.040 only nine percent, so basically one in ten are actually 0:41:51.160 --> 0:41:56.200 given asylum in this country. But what about the ninety percent, 0:41:56.560 --> 0:41:59.920 I mean they're supposed to be removed. Do we know 0:42:00.120 --> 0:42:05.600 how many are actually being removed? Very few, exceptionally less 0:42:05.600 --> 0:42:09.960 than ten percent of being removed annually. And we have 0:42:10.040 --> 0:42:13.120 about we have more than nine hundred thousand alien absconders 0:42:13.160 --> 0:42:15.400 in the United States. And but those are people who 0:42:15.480 --> 0:42:18.640 have already had their due process, have had their day 0:42:18.640 --> 0:42:21.680 in court, have been given the opportunity to make an 0:42:21.680 --> 0:42:26.560 application before an immigration judge, have been ordered removed, but 0:42:26.600 --> 0:42:30.200 who remained in the United States. So that's about ten 0:42:30.239 --> 0:42:32.800 percent of the illegal alien population in this country. A 0:42:32.800 --> 0:42:35.719 little bit less, but still it's a huge number. Mexico's an asylum 0:44:13.600 --> 0:44:17.360 granting country and actually has more lenient asylum laws than 0:44:17.400 --> 0:44:19.719 we do in the United States. The fact that these 0:44:19.719 --> 0:44:22.600 people are not doing that suggests that their economic migrants 0:44:22.600 --> 0:44:27.120 and not actually refugees fleeing persecution. There has been some 0:44:27.400 --> 0:44:30.720 reporting we're speaking of Art Arthur everybody. He's a resident 0:44:30.760 --> 0:44:33.160 fellow in law and policy at the Center for Immigration Studies. 0:44:33.239 --> 0:44:38.200 It's been some reporting that another caravan convoy whatever we 0:44:38.280 --> 0:44:41.719 call it, is gathering in Honduras to make its way 0:44:42.800 --> 0:44:44.440 all the way up to the US Mexico border. Is that how 0:45:07.200 --> 0:45:12.279 it goes, That's correct. That's why the president's policy of 0:45:13.000 --> 0:45:16.160 you know, not allowing individuals who enter the United States 0:45:16.560 --> 0:45:19.760 illegally to claim asylum to get them to the ports 0:45:19.800 --> 0:45:22.080 of entry Mexico is indicated that they'll take care of 0:45:22.120 --> 0:45:25.120 them while they're in Mexico so that they can be 0:45:25.160 --> 0:45:28.799 processed in an orderly fashion at the ports of entry, 0:45:28.880 --> 0:45:31.480 rather than you know, attempting to enter through the bootheel 0:45:31.560 --> 0:45:34.279 of New Mexico, which is the most desolate place I've 0:45:34.280 --> 0:45:38.520 ever been to, and you know, run the risk of 0:45:38.560 --> 0:45:41.239 them or their children dying. It's also important to note 0:45:41.520 --> 0:45:45.480 the dangers that opposed by the smugglers about I think 0:45:45.480 --> 0:45:48.520 it's something like thirty one percent of all female migrants 0:45:48.840 --> 0:45:52.120 who make that journey or sexually assaulted. Two thirds of 0:45:53.320 --> 0:45:57.080 the migrants in total are assaulted in one way or 0:45:57.120 --> 0:45:59.719 the other subject to some sort of violence. So this 0:45:59.840 --> 0:46:03.360 is amazingly dangerous process by which these people enter the 0:46:03.400 --> 0:46:06.759 United States. And again, the humanitarian thing to do is 0:46:06.840 --> 0:46:09.600 to process them in the first country that they come 0:46:09.640 --> 0:46:12.840 to Mexico or alternatively, have them go to the un 0:46:13.000 --> 0:46:15.840 HCR in their own country to make their refugee claims 0:46:15.840 --> 0:46:18.880 and they can be processed through there. Or do you 0:46:18.960 --> 0:46:22.319 think that the president declaring an emergency is the right 0:46:22.360 --> 0:46:25.319 I mean, you're a fellow in law and policy. Do 0:46:25.360 --> 0:46:27.479 you think that this is the right move if, in fact, 0:46:27.520 --> 0:46:31.120 the Democrats don't give him a single dollar for additional 0:46:31.160 --> 0:46:35.239 barrier construction, which seems to be the direction this is heading.
