Okay, so now you said 0:14:49.030 --> 0:14:52.030 through defending editor, you've now asked the Department of Education 0:14:52.030 --> 0:14:54.750 to investigate Smith College. What's going on here? 0:14:55.190 --> 0:14:58.830 Well, what that entitled was filing a 15 page federal 0:14:58.830 --> 0:15:02.990 complaint with the Federal Office for Civil Rights at the U.S. 0:15:02.990 --> 0:15:07.390 Department of Education. They're now trapped in a woman's body. Well, why is that? Because Tennessee's law restricted 0:27:17.200 --> 0:27:22.340 things like cross-sex hormones, puberty blockers, and so-called gender affirming 0:27:22.340 --> 0:27:30.300 care like mastectomies. Two biological adults over the age of 19. 0:27:30.340 --> 0:27:35.420 As it should. Why? Because all of the legislators got together, 0:27:35.420 --> 0:27:39.060 and the governor agreed that after floor debate, this was 0:27:39.060 --> 0:27:43.100 something they felt strongly about. They wanted to protect minor 0:27:43.100 --> 0:27:47.980 children in the state. And this was a controversial, highly 0:27:48.020 --> 0:27:51.660 debated issue. And I'm quoting the justice here, the chief 0:27:51.660 --> 0:27:55.460 justice who wrote the opinion. This is an issue better 0:27:55.460 --> 0:27:59.380 left to the people and their elected representatives almost taking 0:27:59.380 --> 0:28:03.420 a line from the Dobbs v Jackson Womens playbook, in 0:28:03.420 --> 0:28:06.740 which they said issues like abortion should be left to 0:28:06.780 --> 0:28:10.700 the people and their elected representatives. We don't want judges 0:28:10.700 --> 0:28:14.420 who are not scientists, who are not parents, who are 0:28:14.420 --> 0:28:20.129 not educators or legislators to be making politically charged decisions. 0:28:20.130 --> 0:28:22.970 We simply want them to protect the rule of law 0:28:23.210 --> 0:28:27.450 and the power of states to decide things like medical 0:28:27.450 --> 0:28:29.650 regulation for themselves. 0:28:30.530 --> 0:28:33.010 Well, why the United States? So how did the equal protection work its 0:28:48.770 --> 0:28:51.930 way into this case? Because that's what the U.S. was 0:28:51.930 --> 0:28:54.410 arguing here. And what was it about protected classes? How 0:28:54.410 --> 0:28:55.490 does all of that work? 0:28:56.210 --> 0:28:59.290 That's a great question. In fact, this was a question 0:28:59.290 --> 0:29:02.210 I was kind of hoping that the Supreme Court would clarify. 0:29:02.250 --> 0:29:06.570 So the Equal Protection Clause of the 14th Amendment guarantees 0:29:06.570 --> 0:29:12.090 every American so-called equal protection of the laws. Now, in 0:29:12.090 --> 0:29:15.510 many cases, the Supreme Court has taken that promise in 0:29:15.510 --> 0:29:18.550 the 14th amendment and had to apply it to real 0:29:18.590 --> 0:29:24.150 world situations like, for example, race discrimination, or in United 0:29:24.150 --> 0:29:28.070 States versus Virginia, a case in which Justice Ruth Bader 0:29:28.110 --> 0:29:32.310 Ginsburg wrote the majority opinion on the basis of sex. 0:29:32.350 --> 0:29:36.030 These are two classifications in which the Supreme Court has 0:29:36.030 --> 0:29:40.470 said specifically, these are characteristics that are arbitrary. They are 0:29:40.470 --> 0:29:44.870 what are called immutable characteristics. You can't do anything about them. 0:29:44.870 --> 0:29:47.350 They were granted to you simply by what the court 0:29:47.350 --> 0:29:52.670 calls accident of birth, like national origin or ethnicity. They 0:29:52.670 --> 0:29:56.750 basically come with a package. You are born either to 0:29:56.870 --> 0:29:59.989 an African American family or an Asian family or a 0:30:00.030 --> 0:30:02.750 white family. You are born either male and female. These 0:30:02.750 --> 0:30:06.270 are things that come with you from the moment of 0:30:06.270 --> 0:30:11.750 your conception. We have to protect those particular characterizations, but 0:30:11.750 --> 0:30:15.090 they did not get to the question of whether or 0:30:15.090 --> 0:30:20.010 not gender identity or transgender status are the same as 0:30:20.010 --> 0:30:24.290 those protected categories. The reason I was hopeful that they 0:30:24.290 --> 0:30:27.930 would offer some clarification on this is because we actually 0:30:27.970 --> 0:30:32.890 see four more cases pending on cert petition at the 0:30:32.890 --> 0:30:39.970 Supreme Court that simply indicate that clarity would help conclude 0:30:39.970 --> 0:30:43.770 those cases, whether it's on insurance coverage, whether it's on 0:30:43.770 --> 0:30:48.450 women's sports, or whether it's on other states and so-called 0:30:48.450 --> 0:30:52.090 gender affirming care bans. I was hopeful the Supreme Court 0:30:52.130 --> 0:30:55.610 would weigh in. Now. The majority did not. But in 0:30:55.610 --> 0:31:01.050 a separate opinion, Justice Amy Coney Barrett said transgender status 0:31:01.250 --> 0:31:04.050 is not the same as sex and we have not 0:31:04.050 --> 0:31:07.850 decided that it is. This is something the court should 0:31:07.890 --> 0:31:11.370 have taken up. I think the Chief Justice Roberts took 0:31:11.370 --> 0:31:14.469 the middle way and he said, we're not going to 0:31:14.470 --> 0:31:18.030 address equal protection. We're not going to address what's called 0:31:18.030 --> 0:31:21.830 heightened scrutiny, that we have to look closer at those 0:31:21.830 --> 0:31:26.870 kinds of distinctions in state law. Instead, he said, it 0:31:26.870 --> 0:31:31.310 makes no distinction for anyone based on anything other than 0:31:31.310 --> 0:31:34.430 the medical use of these procedures and the age of 0:31:34.430 --> 0:31:37.830 the individual. I think that was a lost opportunity. 0:31:37.990 --> 0:31:40.270 Yeah, it was a sidestep, without a doubt. So many 0:31:40.270 --> 0:31:42.150 things here. First of all, I think the Supreme Court, 0:31:42.150 --> 0:31:45.350 speaking of sidesteps, can only sidestep this so far. If 0:31:45.350 --> 0:31:47.790 the legality of title nine as an example were to 0:31:47.790 --> 0:31:49.750 be brought up. This is a hypothetical before the court. 0:31:49.750 --> 0:31:51.510 They'd have to rule on the question of sex, because 0:31:51.510 --> 0:31:54.030 that's the spinal column for everything in title nine. So 0:31:54.030 --> 0:31:55.790 you can sidestep it all you want to and say, 0:31:55.790 --> 0:31:57.790 we're not physicians.
