There's been a recent prosecution over in this case, 0:06:11.320 --> 0:06:15.840 of course, a USAID administrator who was dolling out contracts 0:06:15.880 --> 0:06:18.360 to the tune of hundreds of millions of dollars and 0:06:18.440 --> 0:06:23.320 receiving kickbacks pursue with these firms. 0:06:23.839 --> 0:06:26.159 But beyond that, the main allegations are. 0:06:26.560 --> 0:06:30.040 That you have these pass through entities where a firm 0:06:30.120 --> 0:06:34.240 puts itself out there as being owned by a minority 0:06:34.279 --> 0:06:38.600 business owner and then subcontracts out the work to massive 0:06:38.640 --> 0:06:42.560 defense contractors, for example. So essentially the idea is that 0:06:42.600 --> 0:06:45.000 you have a front company that looks like a minority 0:06:45.040 --> 0:06:47.159 company and they don't really do any of the work, 0:06:47.360 --> 0:06:50.360 but they collect the fees and then they shift a 0:06:50.400 --> 0:06:55.760 percentage of those fees onto a major company that actually 0:06:55.760 --> 0:06:58.080 does most of the work. And then of course there's 0:06:58.120 --> 0:07:02.120 the idea that their companies who claim to be socially 0:07:02.160 --> 0:07:05.960 and economically disadvantaged and in reality should not be based 0:07:06.040 --> 0:07:09.720 upon the criteria set up by SPA. And there have 0:07:09.800 --> 0:07:13.560 been studies done by Inspectors General to show that so 0:07:13.800 --> 0:07:16.800 one thing is the waste fraud abuse and that this 0:07:17.480 --> 0:07:21.960 looks like a racial preference program that is potentially rife 0:07:21.960 --> 0:07:25.280 with fraud, and that's led to all sorts of scrutiny 0:07:25.760 --> 0:07:29.240 by the SPA, by the Treasury Department, now by the 0:07:29.280 --> 0:07:33.960 Department of War, according to recent announcement by Secretary Hegith. 0:07:34.440 --> 0:07:38.440 And beyond the other aspect is is this thing legal 0:07:38.680 --> 0:07:43.760 in the first place, and there are regulations underpinning how 0:07:43.880 --> 0:07:48.920 this program is actually executed that suggests that there is 0:07:48.960 --> 0:07:54.280 a rebuttable presumption that you are a socially and then 0:07:54.320 --> 0:07:57.960 economically disadvantaged business if you are a member of a 0:07:58.000 --> 0:07:58.920 minority group. 0:07:59.400 --> 0:08:01.920 That present umption was challenged. 0:08:02.040 --> 0:08:04.560 So basically, if you are not a minority, you have 0:08:04.680 --> 0:08:07.520 to prove that you're socially and economically disadvantaged. But if 0:08:07.560 --> 0:08:11.240 you are, you're assumed to qualify for the program unless 0:08:11.280 --> 0:08:13.760 there's evidence shown to the contrary, and that evidence is 0:08:13.800 --> 0:08:19.640 basically never shown. So while you had a court 0:09:05.840 --> 0:09:09.480 say this rebuttable presumption for the SBA doesn't pass legal muster, 0:09:09.720 --> 0:09:12.960 and the Biden administration tried to find a workaround, the 0:09:13.160 --> 0:09:16.640 underlying regulation has been adopted by a ton of other 0:09:16.720 --> 0:09:22.640 agencies in doling out awards under programs to advance quote 0:09:22.720 --> 0:09:26.560 unquote socially and economically disadvantaged individual So this looks like 0:09:26.840 --> 0:09:30.840 racial preferences that continue to exist.
